Privacy Policy

This Privacy Policy applies to Mynd Inc. and Neus (“Mynd”, “Neus”, “We,” “Us,” or “Our”) and describes the collection, use, disclosure, and protection of information gathered through the Mynd network of Websites, including mynd.inc (hereinafter “Web sites” or “Sites”) and through Mynd published mobile applications (hereinafter “Apps”) (together hereinafter “Services”). Mynd is committed to protecting the confidentiality and security of information it collects through its Websites and Apps. Please read the following carefully. Your use of the Web sites and Apps is governed by this Privacy Policy, along with Mynd’s Terms of Service (available here: https://www.mynd.inc/terms). Our Privacy Policy or Terms of Service do not apply to any third-party websites, services or applications, even if they are accessible through our Services.

By using our Sites and Apps, you are accepting the practices described in our Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Sites and Apps. We reserve the right to modify or amend the terms of our Privacy Policy from time to time without notice. Your continued use of our Sites and Apps following the posting of changes to these terms will mean you accept those changes.

  1. Revisions to this Privacy Policy. Any information that is collected via our Services is covered by the Privacy Policy in effect at the time such information is collected. We may revise this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we’ll notify you of these changes by posting them on the Services or other notification, and we’ll update the “Last Updated Date” above to indicate when those changes will become effective. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you use the Services after the updated Privacy Policy is posted on the Services.
  2. Information We Collect or Receive. We collect the following information, much of these are device-related and non-personal information, which alone cannot be used to identify you.
    • Device Related Information. We collect IP address, device ID, cookies, user settings and preferences, operating system, and app version about your device.
    • Location Information. We may collect location information about your device that you volunteer or enable through the App or your device. We will not collect any location information that you do not volunteer or enable.
    • Usage Information. We collect information about how you use our Apps, such as the type of content you view, and the time, frequency and duration of your activities, advertisement interactions and other usage information and performance data related to the Sites and Apps and usage of them.
    • Information You Provide When You Create an Account. You must provide your mobile phone number and basic information (including a profile name of your choice) to create a Neus account. If you don’t provide us with this information, you will not be able to create an account to use our Services. You can add other information to your account, such as a profile picture.
    • Chat data. Content of communications between you and another user or group of users. Neus is a cloud service. We store messages, photos, videos and documents from your cloud chats on our servers so that you can access your data from any of your devices anytime without having to rely on third-party backups. All data is stored heavily encrypted and the encryption keys in each case are stored in several other data centers in different jurisdictions. This way local engineers or physical intruders cannot get access to user data.
    • Your Contacts. You can provide us access, if permitted by applicable laws, to your on-device contact list, including those of users of our Services and your other contacts. If any of your contacts aren’t yet using our Services, we’ll manage this information for you in a way that ensures those contacts cannot be identified by us. You can create, join, or get added to groups, and such groups and lists get associated with your account information. You give your groups a name. You can provide a group profile picture or description.
    • Transactions And Payments Data. If you use our Premium Services, we process additional information about you, including payment account and transaction information. Payment account and transaction information includes information needed to complete the transaction (for example, information about your payment method, and transaction amount).
    • Information You Provide as One-Time Request. You may provide us with certain information when you submit a request, claim or event on our Apps or to us. When you contact us for customer support or otherwise communicate with us, you may provide us with information related to your use of our Services, including copies of your messages, any other information you deem helpful, and how to contact you (e.g., an email address). For example, you may send us an email with information relating to app performance or other issues.
    • Surveys. We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information about you.
    • Information Others Provide About You. We receive information about you from other users. For example, when other users you know use our Services, they may provide your phone number, name, and other information (like information from their mobile address book) just as you may provide theirs. They may also send you messages, send messages to groups to which you belong, or call you. We require each of these users to have lawful rights to collect, use, and share your information before providing any information to us. You should keep in mind that in general any user can capture screenshots of your chats or messages and send them to Neus or anyone else, or post them on another platform.
    • Third-Party Service Providers. We work with third-party service providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with them to distribute our apps; provide our technical and physical infrastructure, delivery, and other systems; provide engineering support, cybersecurity support, and operational support; supply location, map, and places information; process payments; help us understand how people use our Services; market our Services; help you connect with businesses using our Services; conduct surveys and research for us; ensure safety, security and integrity; and help with customer service. These companies may provide us with information about you in certain circumstances; for example, app stores may provide us with reports to help us diagnose and fix service issues.
  3. How We Use Your Information. Our primary purposes for the collection and processing of information is to provide our Services (to perform our contract with you), to improve our Services, to administer your use of the Services, to market the Services to you, and to enable you to enjoy and easily navigate our Services. Also, we may process your information where we have a legitimate interest (e.g., fraud prevention, network and information security, research (including marketing research), and direct marketing), and as you otherwise consent. We will use your information in one or more of the following ways:

      Performing Services for You:

    • As necessary for the Web sites or Apps to function or provide you with Services properly;
    • Automatically update the App on your device;
    • Improve user experience;
    • Perform statistical, demographic, and marketing analyses of users of the App;
    • Communicate with you about your questions, claims or technical support; and
    • Communicate with you about changes to our policies, and send you information about features and enhancements on our Sites and Apps.
    • Advertising Customization:

    • Personalize content and experiences on our Apps, including providing you reports, recommendations, ads and feedback based on your preferences.
    • Internal Research and Development; Quality Control:

    • In the aggregate to help us evaluate and modify existing services and to help us develop additional services that are likely to be of interest to our users;
    • Optimize or improve our products, services and operations; and
    • To monitor quality control and ensure compliance with our legal obligations, codes and ordinances, policies and procedures.
    • Security Detection, Protection and Enforcement; Functionality Debugging, Error Repair:

    • Detect, investigate, and prevent activities that may violate our policies or be illegal;
    • Recognize repeat visitors and facilitate ongoing access to the Web sites or Apps; and
    • Verify your or your authorized agent’s identity.
    • Other uses about which we notify you.

  4. Information We Share with Third Parties. We share your information to help us operate, provide, improve, understand, customize, support, and market our Services. We will not share any information that we have collected from or regarding you except as described below:
    • Software Development Kits. We may use our advertising partners’ software development kits (“SDKs”). Our Advertising Publisher Partners can access your information through the SDKs so that they can decide whether to bid on ad inventory or serve an advertisement and choose the best ad for you on our Apps
    • Affiliates and Service Providers. We engage our affiliates and service providers to administer or provide Our Services. We may share the information we collect with our affiliates or service providers who may process the information in their facilities subject to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures.
    • Third-Party Service Providers. We work with third-party service providers to help us operate, provide, improve, understand, customize, support, and market our Services. We work with these companies to support our Services, such as to provide technical infrastructure, delivery and other systems; market our Services; conduct surveys and research for us; protect the safety, security and integrity of users and others; and assist with customer service. When we share information with third-party service providers in this capacity, we require them to use your information on our behalf in accordance with our instructions and terms.
    • Third-Party Services. When you or others use third-party services that are integrated with our Services, those third-party services may receive information about what you or others share with them. For example, if you use a data backup service integrated with our Services (like iCloud or Google Drive), they will receive information you share with them, such as your Neus messages. If you interact with a third-party service linked through our Services, such as when you use the in-app player to play content from a third-party platform, information about you, like your IP address and the fact that you are a Neus user, may be provided to such third party. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services and products.
    • Legal Obligations. We cooperate with government and law enforcement officials or private parties to enforce and comply with applicable laws and regulations.
  5. Information You Share.You share your information as you use and communicate through our Services, and we share your information to help us operate, provide, improve, understand, customize, support, and market our Services.
    • Send Your Information To Those With Whom You Choose To Communicate.You share your information (including messages) as you use and communicate through our Services.
    • Information Associated With Your Account.Your phone number, profile name and photo, are available to anyone who uses our Services
    • Your Contacts And Others. Users with whom you communicate can store or reshare your information (including your phone number or messages) with others on and off our Services.
  6. Your Choices.You may have the right to opt out of certain uses of your information:
    • Opt-out of Ad Tracking. If you would like to opt-out of the sharing of your information in connection with personalized advertising in desktop and mobile browsers, please visit http://optout.aboutads.info/ or http://optout.networkadvertising.org/ on each of your devices and browsers. To opt-out in mobile apps, you may use your device’s “Limit Ad Tracking” or similar settings at https://www.networkadvertising.org/mobile-choice or download and use the AppChoices app at http://www.aboutads.info/appchoices on each of your devices.
    • More Opt-out on Mobile Apps. You have choices when it comes to how Apps function on your mobile device. Access to or availability of controls may vary depending on your device. You may be able to:
      1. Manage push notifications by using your built-in mobile device settings and controls;
      2. Manage location information by using your built-in mobile device settings and controls;
      3. Manage/restrict in-app purchases by using your built-in mobile device settings and controls; or
      4. Block navigation to the web by turning off network access on the device or turning off the browser.
  7. California Residents Only. As a California resident, you will have other following rights with respect to your personal information of prior 12 months:
    • Right to know.You have the right to request that we disclose to you the personal Information we collect, use, or disclose, and information about our data practices, including the categories of personal information we collect, the categories of sources of such information, our business purpose for collecting or sharing such information, and the categories of third parties with whom we share such information;
    • Right to receive a copy.You have the right to receive a copy of the personal information we have collected about you;
    • Right to request deletion. You have the right to request that we delete your Personal Information that we have collected from you subject to certain exceptions;
    • Right to non-discrimination. We will not discriminate against you for exercising any of these rights.
  8. To exercise these rights, you can choose to:
    • Send an email to admin@mynd.inc with a subject of “CCPA Request”; or
    • Open our App, choose Settings `>` Preferences, click Contact Us , and then send a message with a subject of “CCPA Request".
  9. In order to protect your information, we may need to verify your identity (that you are the persona about whom we collected personal information) before processing your request. In some cases we may need to collect additional information to verify your identity, such as a government issued ID.

    We cannot respond to your request or provide you with personal information if we cannot verify your identity and confirm that the personal information relates to you. Please understand due to very limited personal information we received, we might not be able to verify your identity and process your request.

    Under the CCPA, You can also designate an authorized agent to exercise your rights on your behalf. We may request that your authorized agent have written permission from you to make requests on your behalf and may need to verify your authorized agent’s identity.

    Do not Sell My Info. We do not sell your personal information. We and our advertising partners may collect certain information about your devices to deliver personalized ads to you (e.g., cookies, advertising identifiers, IP address, usage history, geolocation) when you visit our sites or use our apps. These ads help to fund our websites and apps and make certain features free for you.

The Security of Your InformationWe take reasonable administrative, physical and electronic measures designed to protect the information that we collect from or about you from unauthorized access, use or disclosure. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the security of any information.
  11. Data Retention We retain the information we collect for as long as your use of our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
  12. Links to Other Sites.Our Services may contain links to websites and services that are owned or operated by third parties (each, a “Third-party Service”). Any information that you provide on or to a Third-party Service or that is collected by a Third-party Service is provided directly to the owner or operator of the Third-party Service and is subject to the owner’s or operator’s privacy policy. We’re not responsible for the content, privacy or security practices and policies of any Third-party Service. To protect your information we recommend that you carefully review the privacy policies of all Third-party Services that you access.
  13. Data Processing.Our Sites are maintained on AWS servers located in the U.S., and your information is processed and stored in the U.S.. If you are visiting our Sites from outside the U.S., please be advised that your information is transferred in the U.S.
  14. Our Policy toward People under 13. Our Services are not directed to people under 13 and we do not knowingly collect information from individuals under the age of 13. If you are between 13 and 18, you must have permission from your legal guardian before you are permitted to use the Services. If we learn that we have collected information of an individual under 13 we will take steps to delete such information from our files as soon as possible.
